It's important to read and understand these Terms, as they constitute a legal agreement between you and Virtuoso. Please note that by using the Services, you agree to comply with these Terms, which govern your access, usage, affiliation, and operation of the Services within the United States and its territories. The term "including" in these Terms encompasses but is not limited to the items listed. It's essential to understand that these Terms, along with all referenced documents and policies, form a legally binding agreement. By accessing, downloading, installing, or using the Service, you indicate your understanding and agreement to be bound by the terms outlined in this agreement.
We appreciate your interest in Virtuoso. Our mission is to foster connections among individuals by facilitating daily tasks and fostering community engagement through our web applications and services (collectively referred to as the "Services").
At Virtuoso, we highly prioritize the privacy of our users. This Privacy Policy outlines the information we collect from Users and Fulfillers (as defined below), how we utilize it, share it, and safeguard it. It is designed to address the concerns of individuals regarding the use of their personally identifiable information ("PII") online. PII, as defined by US privacy laws and information security standards, refers to data that can either alone or in conjunction with other information identify, contact, or locate an individual or identify an individual within a specific context.
Additionally, please note that your use of our Services is governed by our Terms and Conditions ("Terms and Conditions"). Both this Privacy Policy and the Terms of Service may be updated periodically. Your continued use of the Services indicates your acknowledgment and acceptance of any changes.
To access and utilize our Services, you must agree to the terms outlined in this Privacy Policy. Throughout this document, the term "including" is used to signify that the listed items are inclusive but not limited to those mentioned. By accessing, downloading, installing, or using our Services, you confirm that you have read, comprehended, and consented to abide by the terms stated in this Privacy Policy.
- Information We Collect
Information we collect includes information you provide to us as well as information we collect while you use the Services and information we collect from third-parties.
- Information You Provide to Us
Information Provided During Registration – Upon creating a Virtuoso account, you provide us with your name, email address, residential address, and telephone number.
User Profile Details – Upon becoming a part of the Virtuoso community, you have the option to create a Virtuoso profile ("Profile"). This Profile allows you to share interesting details about yourself and discover common connections and interests with others. It's entirely up to you how much information you choose to include in your Profile, as filling it out is voluntary. At a minimum, your Profile will always display your name (and for Fulfillers, their Profile photos). Further information on controlling who can view your Profile is provided below. Additionally, you have the option to create a Profile for a business organization or entity ("Business Profile") within your account, requiring a designated business email address and payment method.
Adding Payment Method – When you add a credit card or any payment method to your Virtuoso account, a third-party payment processor that manages payments on our behalf will receive your credit card details. To ensure the security of your financial information, we do not retain complete credit card data on our servers.
Fulfiller Application Details – The Services function as a marketplace connecting individuals seeking task completion with independent contractors and businesses ("Fulfillers") capable of fulfilling these tasks, jobs, or offers. Should you choose to become part of our Fulfiller community, in addition to the essential registration details, we may request further information such as your date of birth, residential address, Social Security Number, Fulfiller's license particulars, and, where applicable, additional business license or permitting details in certain jurisdictions. This information may be shared with our partners who assist us in conducting background checks on Fulfillers, contributing to the safeguarding of the Virtuoso community.
Payment Details – In order to facilitate payment to Fulfillers, we may retain information regarding Fulfillers' bank routing numbers, tax details, and any additional payment information provided by Fulfillers.
- Information We Collect When You Use the Services
Location Details – Virtuoso operates on the principle of connecting Fulfillers and Users, requiring knowledge of your whereabouts. If you designate specific locations such as "home" or "work," we also receive this information.
Your location data is essential for tasks such as pairing Users with nearby Fulfillers. Additionally, in case of any necessity, our staff may utilize and disclose location information to ensure the safety of Users or members of the public.
Device Details – Virtuoso collects data from Users' devices, encompassing IP addresses, web browser types, versions of mobile operating systems, phone carriers, manufacturers, installed applications, device identifiers, mobile advertising identifiers, push notification tokens, and, if you register using your Facebook account, your Facebook identifier.
Usage Data – In order to enhance our Services and better comprehend how they are utilized, we automatically gather information regarding your interactions with the platform. This includes details such as the pages or other content you access, your activities within the application, and the dates and times of your visits.
Call and Text Data – We may collaborate with a third-party partner to facilitate phone calls and text messages between Users and Fulfillers once they've been connected for a service. As part of this process, we may obtain information regarding these communications, including the date and time of the call or SMS message, the phone numbers of the parties involved, and the content of any SMS messages. For security purposes, we reserve the right to monitor and/or record the contents of phone calls made via the Services, such as those between Users and Fulfillers. You will receive notice that your call may be recorded, and by proceeding, you consent to Virtuoso's monitoring and/or recording of your call.
User Feedback – Users and Fulfillers have the opportunity to rate and review each other, providing valuable feedback. We may receive information regarding these ratings and reviews.
- Information We Collect from Third-Parties
Third-Party Integration – If you opt to register for Virtuoso or connect your Virtuoso account with a third-party service (such as Facebook), we may acquire similar information directly from those services, as outlined in the description above.
Third-Party Partners – We may receive additional information about you, such as demographic data, payment information, or fraud detection information, from third-party partners and combine it with other information that we have about you.
Enterprise Initiatives – In the event that your company, university, or organization engages in one of our enterprise programs, we might receive details about you, such as your email address, from your participating organization. Additionally, we may grant your participating organization the option to request a service on your behalf. In such instances, they may furnish us with your name, phone number, and the type of service you require.
Background Checks for Fulfillers – Virtuoso collaborates with third-party partners to conduct background checks and review past records of Fulfillers. We may obtain information from these partners, including publicly available data regarding a Fulfiller's past record or criminal history.
We do not engage in the sale or trade of your personally identifiable information (PII) to external entities.
- How We Use the Information We Collect
- We utilize the information we gather from Users to:
- Facilitate connections between Users and Fulfillers;
- Deliver, enhance, broaden, and advertise the Services;
- Examine the usage patterns within the Virtuoso community utilizing the Services;
- Correspond with you, either directly or via one of our associates, including for marketing and promotional objectives;
- Tailor the Virtuoso experience to suit your preferences and those of your friends and contacts;
- Transmit text messages and push notifications to you;
- Enable transactions and facilitate payments;
- Offer customer support services to assist you;
- Identify and prevent fraudulent activities; and
- Address trust and safety concerns as they arise, manage disputes between Users and Fulfillers, and handle requests from governmental authorities.
- Moreover, we may utilize the information gathered from Fulfillers for the following objectives:
- Sending emails and text messages to Fulfillers who have initiated the Fulfiller application process regarding the status of their application;
- Assessing a Fulfiller's eligibility to provide additional services for Virtuoso;
- Informing Fulfillers about service requests, pricing, and updates regarding services; and
- Calculating and furnishing Virtuoso's policies and analyzing usage patterns for safety and insurance purposes.
- How We Share the Information We Collect
- Sharing between Users and Fulfillers - Users and Fulfillers that have been matched for a service or other services may be able to see basic information about each other, such as names, photos, ratings, and any information they have added to their Profiles. Users and Fulfillers who connect their Virtuoso accounts to Facebook may also be able to see their mutual Facebook friends during the service or during the completion of a service request. Fulfillers may see the pick-up location that the User has provided. Users may see a Fulfiller’s profile information. Users’ ratings of Fulfillers may be shared with Fulfillers on a weekly basis. We de-identify the ratings and feedback, but we can’t rule out that a Fulfiller may be able to identify the User that provided the rating or feedback.
Although we may help Users and Fulfillers communicate with one another to arrange a service, we do not share your actual phone number or other contact information with other Users. If you report a lost or found item to us, we will seek to connect you with the relevant assistant or Fulfiller, including sharing actual contact information with your permission.
- Sharing Between Virtuoso and Third-PartiesAPI and Integration Partners – If you integrate with the Services through a third-party service, we may disclose details about your use of the Services to that third-party. We might share your information with our third-party partners to acquire additional information about you. Additionally, we may share your information with third-party partners to generate offers that may be of interest to you.
Third-Party Services – Our platform may enable connections with other websites, products, or services that are beyond our control. If you choose to use these services, we will share information about you with the respective third-party to facilitate the provision of the service (for instance, we may provide them with your name, phone number, and address for delivery purposes). We cannot vouch for the privacy practices of these third-parties, and we recommend reviewing their privacy policies before deciding to use their services.
- Service Providers – We collaborate with third-party service providers to carry out tasks on our behalf, and we may share your information with these service providers to assist us in delivering the Services, encompassing all the activities outlined in Subsection C of the section titled "Information We Collect" above.
- Enterprise Partners – If you engage in an enterprise program and charge a service to your organization's billing method or credits, we may furnish your organization's account holder with details about your usage of the Services, including service delivery specifics such as date, time, charge, and service type. Should you create a Business Profile, you'll have the opportunity, at the conclusion of each service, to classify it as a business service. If you opt to do so, and if your organization maintains a corporate account with Virtuoso, we may disclose information concerning your utilization of the Services to your organization, including service particulars like date, time, charge, and location. In the event of an organizational change, it is your responsibility to update your Business Profile with the new information. (Please ensure to verify and adjust your designation settings accordingly.) If you integrate your account with an expense platform, such as Concur, we may transmit the service details to your expense account.
- International Partners – We may collaborate with various service-sharing platforms worldwide to ensure that Users can access services even when they are abroad, and Fulfillers can offer services to international travelers in the U.S. If we facilitate a service match with one of our partners, we may exchange the same information that is typically shared between matched Users and Fulfillers on our platform. In certain instances, we may be unable to conceal your phone number if you contact an international Fulfiller, so please consider this before utilizing this feature.
- Other Sharing: We might disclose your information to third-parties in the following scenarios:
- During negotiations or in connection with a change of corporate control, such as a restructuring, merger, or sale of our assets;
- If a government authority requests information and we deem disclosure necessary or appropriate to comply with laws, regulations, or legal processes;
- With law enforcement officials, government authorities, or third-parties if we believe such action is necessary to safeguard the rights, property, or safety of the Virtuoso community;
- To adhere to a legal obligation or process, which may include but is not limited to civil and criminal subpoenas, court orders, or other mandatory disclosures;
- If you utilized another User's referral or promotion code when signing up for a promotion, we may share information with your referrer to inform them of your redemption or qualification for the promotion;
- With our insurance partners to assist in determining and offering relevant coverage in the event of an incident;
- To furnish potential business partners with information regarding the usage of the Services in aggregated or de-identified form that cannot reasonably identify you; and
- How do we ensure the security of visitor information?
We conduct routine scans of our website to identify and address any security vulnerabilities, ensuring a safe browsing experience for visitors. Our site undergoes regular malware scanning to mitigate risks.
Visitor personal information is securely stored behind restricted networks, accessible only by authorized personnel who are obligated to maintain confidentiality. Additionally, sensitive or credit-related data provided by users is encrypted using Secure Socket Layer (SSL) technology.
To maintain the security of user information, we employ various protective measures when users input, submit, or access their data.
All transactions are handled through a secure gateway provider and are not stored or processed on our servers.
- Options for Users
- Email Preferences – You have the option to opt out of receiving commercial or promotional emails from us at any time. However, please note that we will continue to send you transactional and relational emails pertaining to your account and use of the Services.
- Push Notification Preferences – You have the ability to disable push notifications through your device settings. However, it's important to note that opting out of push notifications may affect your experience with the Services, such as receiving notifications about the status of your service.
- Virtuoso Profile Details – While your name may be visible to Fulfillers, you have the option to remove any additional information you've added to your Profile if you prefer not to share it with Fulfillers. Users may have access to Fulfillers' names, ratings, profile photos, and vehicle details.
- Location Information for Users – While you have the ability to stop your device from sharing location data at any time through your device's operating system settings, please note that location information is integral to the functionality of the Services. Without access to location data from Users and Fulfillers, we may be unable to deliver our services effectively.
- Facebook Friends Feature – You have the option to manage the Facebook mutual friends feature by enabling or disabling it through your profile settings.
- Managing Your Information – You have the ability to review and modify certain account details by logging into your account settings and profile. Fulfillers may also edit additional information through the Fulfiller portal.
- If you decide to terminate your Virtuoso account - we will deactivate it upon your request. However, please be aware that we may retain certain information from your account for a specific duration and disclose it in accordance with our practices outlined in this Privacy Policy for accounts that remain active. Additionally, we may retain information from your account to settle any outstanding fees, address disputes, resolve issues, analyze usage of the Services, aid in investigations, prevent fraud, enforce our Terms of Service, or undertake other actions as necessary or permitted by law.
- Data Security – Safeguarding the data of the Virtuoso community is of utmost importance to us. While we implement reasonable precautions to protect your data, it's important to note that no security measure can provide absolute assurance, and therefore, we cannot guarantee the complete security of your data.
- Children's Privacy – Virtuoso is not intended for children, and we do not knowingly collect personal information from individuals under the age of 13. If we become aware that we have inadvertently obtained personal information from a child under 13, we will take steps to delete such information. If you believe that a child under 13 has provided us with personal information, please contact us immediately.
- Changes to Our Privacy Policy – We reserve the right to update this Privacy Policy periodically. If any significant changes are made, we will notify you through the Services, via email, or other means of communication. We recommend reviewing this Privacy Policy regularly to remain informed about our privacy practices. By continuing to use the Services, you agree to abide by this Privacy Policy and any subsequent updates we make to it.
